However, the impact of the choice of certain licences must sometimes be taken into account. <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Funder&#8217;s request<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">Some funders require authors to have a CC-BY licence. For example, <a href=\"https:\/\/www.ukri.org\/news\/ukri-announces-new-open-access-policy\/\" target=\"_blank\" rel=\"noreferrer noopener\">UKRI<\/a> requires authors whose research they have funded to publish in CC-BY or exceptionally CC-BY-ND or CC-BY-NC. <\/p>\n\n<p class=\"wp-block-paragraph\">It is the responsibility of the author, at the time of submission, to check whether the journal accepts the licence requested by its funder. Tools exist to find out the policy of funders, for example <a href=\"https:\/\/v2.sherpa.ac.uk\/juliet\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sherpa Juliet<\/a>.<\/p>\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-7387b849 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\">\n<h2 class=\"wp-block-heading\">Apply to DOAJ Seal<\/h2>\n<\/div>\n<\/div>\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/doaj.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">Directory of Open Access Journals (DOAJ)<\/a> is a platform that indexes and provides access to open access scientific journals. It recommends the use of CC licences. <\/p>\n\n<p class=\"wp-block-paragraph\">The DOAJ Seal is a label that highlights journals that comply with good open access practices. For a standard application, all licences are accepted. However, to apply for the <a href=\"https:\/\/doaj.org\/apply\/seal\/\" target=\"_blank\" rel=\"noreferrer noopener\">DOAJ Seal<\/a>, only the following licences should be used:  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>CC BY<\/li>\n\n\n\n<li>CC BY-SA<\/li>\n\n\n\n<li>CC BY-NC<\/li>\n\n\n\n<li>CC BY-NC-SA<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">ND licences prohibiting the modification of documents are prohibitive for the DAOJ Seal.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>The case of the CC0 license?<\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">The choice of a <a href=\"https:\/\/www.centre-mersenne.org\/en\/creative-commons-licences\/\" data-type=\"URL\" data-id=\"\/licences-creative-commons\/\">Creative Commons licence<\/a>, while it allows the permissions granted by the author to be specified, does not replace French law.<\/p>\n\n<p class=\"wp-block-paragraph\">Under French law, according to <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006278891\" target=\"_blank\" rel=\"noreferrer noopener\"><u>l\u2019article L121-1 du code de la propri\u00e9t\u00e9 intellectuelle<\/u><\/a> which defines authors\u2019 moral rights: \u00ab L\u2019auteur jouit du droit au respect de son nom, de sa qualit\u00e9 et de son \u0153uvre. Ce droit est attach\u00e9 \u00e0 sa personne. Il est perp\u00e9tuel, inali\u00e9nable et imprescriptible. Il est transmissible \u00e0 cause de mort aux h\u00e9ritiers de l&#8217;auteur \u00bb. Therefore, a work cannot be quoted or re-used without citing its author, even if it has fallen into the public domain. <\/p>\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/creativecommons.org\/publicdomain\/zero\/1.0\/deed.fr\" target=\"_blank\" rel=\"noreferrer noopener\"><u>CC0 licence<\/u><\/a> proposes the renunciation of its copyright. We have seen that moral rights are &#8220;perpetual, inalienable and imprescriptible&#8221;. An author cannot fully waive his rights.  <\/p>\n\n<p class=\"wp-block-paragraph\">Therefore, the Creative Commons licence is not a substitute for copyright law. It simply specifies, in a simple manner, the permissions granted by the author. Thus, in France, using the CC0 licence is in practice equivalent to using the <a href=\"https:\/\/creativecommons.org\/licenses\/by\/4.0\/\" target=\"_blank\" rel=\"noreferrer noopener\">CC-BY<\/a> licence.  <\/p>\n","protected":false},"excerpt":{"rendered":"<p>The choice of a Creative Commons license remains the choice of an author or a journal.
