It is therefore a question of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>check the availability of the title: simply type the desired name into a search engine or check the <a href=\"https:\/\/branddb.wipo.int\/branddb\/fr\/%20-%20https:\/\/branddb.wipo.int\/branddb\/en\/\" data-type=\"URL\" data-id=\"https:\/\/branddb.wipo.int\/branddb\/fr\/ - https:\/\/branddb.wipo.int\/branddb\/en\/\" target=\"_blank\" rel=\"noreferrer noopener\">worldwide trademark database<\/a>.<\/li>\n\n\n\n<li>And, if necessary, it is possible to officially protect the title by registering it as a <a href=\"https:\/\/www.inpi.fr\/proteger-vos-creations\/proteger-votre-marque\/les-etapes-cles-du-depot-de-marque\" target=\"_blank\" rel=\"noreferrer noopener\"><u>trademark<\/u><\/a> via the <a href=\"https:\/\/www.inpi.fr\/\" data-type=\"link\" data-id=\"https:\/\/www.inpi.fr\/\">INPI<\/a> for France or via the <a href=\"https:\/\/efiling.madrid.wipo.int\/application-assistant\/\">Madrid system for other countries<\/a> (a system that allows a single application to be made for a maximum of 128 days&#8217; protection, renewable). <br\/>This is not required, but it allows the title to be declared so that no one else can use it (and thus protect oneself from predatory journals, which choose titles that are similar or even identical to existing journals), and to determine its owner. <br\/>This is the responsibility of the legal publisher, so if you wish to protect your title, you will need to determine who owns the title. <\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-image size-large is-resized\"><a href=\"https:\/\/www.centre-mersenne.org\/wp-content\/uploads\/\/Depot-de-marque_small-1024x738.png\"><img fetchpriority=\"high\" decoding=\"async\" width=\"1024\" height=\"738\" src=\"https:\/\/www.centre-mersenne.org\/wp-content\/uploads\/\/Depot-de-marque_small-1024x738.png\" alt=\"\" class=\"wp-image-5414\" style=\"width:840px;height:auto\" srcset=\"https:\/\/www.centre-mersenne.org\/wp-content\/uploads\/Depot-de-marque_small-1024x738.png 1024w, https:\/\/www.centre-mersenne.org\/wp-content\/uploads\/Depot-de-marque_small-300x216.png 300w, https:\/\/www.centre-mersenne.org\/wp-content\/uploads\/Depot-de-marque_small-768x553.png 768w, https:\/\/www.centre-mersenne.org\/wp-content\/uploads\/Depot-de-marque_small-1536x1107.png 1536w, https:\/\/www.centre-mersenne.org\/wp-content\/uploads\/Depot-de-marque_small.png 1896w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/a><figcaption class=\"wp-element-caption\">centre Mersenne, CC-BY<\/figcaption><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Get an ISSN<\/strong><\/h3>\n\n\n\n<p>All journals distributed to the public must obtain an ISSN number. The <a href=\"https:\/\/www.bnf.fr\/fr\/quest-ce-que-lissn\" target=\"_blank\" rel=\"noreferrer noopener\"><u>ISSN<\/u><\/a> (International Standard Serial Number) is an international standard code that unambiguously identifies a journal. It is this code that will make the difference between two different journals with the same title for example.<\/p>\n\n\n\n<p>Each distribution format must have its own ISSN: if a journal has both a print and a digital format, it will have an ISSN for the print version and an e-ISSN for the digital version. In the event of a change of title, a new ISSN must be requested.<\/p>\n\n\n\n<p>Each country has a national entity responsible for assigning ISSN:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>For French journals, the BNF assigns the ISSN. Thereafter, the publisher must send a global annual declaration each year when the last issue is published.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the journal is <strong>published online<\/strong>, there is no need to do anything. It is therefore responsible for the civil and criminal liability of the published content.<\/p>\n\n\n\n<p><strong>Who can be an publisher?<\/strong> <br\/>A non-profit organisation, a university, an association, a foundation and even an individual.<\/p>\n\n\n\n<p>The legal publisher is an entity often dissociated from the editorial team or from the person who carries the journal project.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>The roles of publisher and publication director<\/strong><\/h4>\n\n\n\n<p>The legal publisher is represented by a publication director, i.e. a natural person who assumes civil and criminal responsibility for the published content.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>For a laboratory, library, university press, university: the president of the university.<\/li>\n\n\n\n<li>For an association: the president of the association.<\/li>\n<\/ul>\n\n\n\n<p class=\"mersenne-box-gris\">The publication director will be the natural person legally representing the legal entity publishing the journal. \u00ab En d\u2019autres termes, le directeur\/la directrice de la publication n\u2019est donc pas n\u00e9cessairement le directeur\/la directrice de la revue, ni celui ou celle exer\u00e7ant les missions de responsable scientifique. This is due to the difference in support. Thus, for example, the printed magazine is subject to legal deposit. It is therefore possible to indicate the date of the latter. The digital version is done by harvesting: it is therefore impossible to indicate a legal deposit date.<\/p>\n\n\n\n<p><a href=\"https:\/\/www.bnf.fr\/fr\/mentions-obligatoires-des-documents-soumis-au-depot-legal\" data-type=\"URL\" data-id=\"https:\/\/www.bnf.fr\/fr\/mentions-obligatoires-des-documents-soumis-au-depot-legal\" target=\"_blank\" rel=\"noreferrer noopener\">Legal notice for the printed version<\/a>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>if the publisher is a legal person, its name or corporate name, its legal form, the address of its registered office, the name of its legal representative and its three main partners;<\/li>\n\n\n\n<li>if the publisher is not a legal entity, the full name and address of the owner or principal co-owner;<\/li>\n\n\n\n<li>the name of the director of the publication and of the editor;<\/li>\n\n\n\n<li>the name (or company name) and address of the printer;<\/li>\n\n\n\n<li>the date of publication ;<\/li>\n\n\n\n<li>the words &#8220;Legal deposit&#8221; followed by the month and year of deposit (provisional);<\/li>\n\n\n\n<li>the price in euros;<\/li>\n\n\n\n<li>the ISSN number assigned after the first deposit.<\/li>\n<\/ul>\n\n\n\n<p><a href=\"https:\/\/hal.archives-ouvertes.fr\/hal-01960919v2\/document\" data-type=\"URL\" data-id=\"https:\/\/hal.archives-ouvertes.fr\/hal-01960919v2\/document\" target=\"_blank\" rel=\"noreferrer noopener\">Legal notice for the digital version<\/a>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the words &#8220;Director of Publication&#8221; followed by his\/her first and last name<\/li>\n\n\n\n<li>the name, address and telephone number of the website host, the e-ISSN, if one has been assigned to the electronic version of the journal;<\/li>\n\n\n\n<li>the name, official address, telephone number of the legal entity publishing the journal (whose legal representative is mentioned as the director of the publication), as well as its share capital and its registration number in the RCS (Trade and Companies Register), if applicable: SA, SAS, SARL, GIE&#8230;<\/li>\n<\/ul>\n\n\n\n<p>On the magazine&#8217;s website, this information often appears in the &#8220;Legal Notice&#8221; section.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Data protection<\/strong><\/h3>\n\n\n\n<p>The <a rel=\"noreferrer noopener\" href=\"https:\/\/www.cnil.fr\/fr\/reglement-europeen-protection-donnees\" target=\"_blank\"><u>R\u00e8glement G\u00e9n\u00e9ral sur la Protection des Donn\u00e9es (RGPD)<\/u><\/a>, which came into force on 25 May 2016, requires individuals to be informed about the processing of their personal information. Thus, in the context of a publishing activity, working with authors involves the collection and processing of personal data.<\/p>\n\n\n\n<p>The review must therefore ensure that this regulation is applied and respected.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Publication agreements\/contracts<\/strong><\/h2>\n\n\n\n<p>The author has de facto moral and economic rights to his work. As a result, the legal publisher, in order to be able to exploit his work (distribute the work, modify it, adapt it to the chosen medium, etc.), must obtain the author&#8217;s permission via a contract for the transfer of rights or publishing contract.<\/p>\n\n\n\n<p>The contract for the transfer of rights must be concluded in writing between the author and the publisher. It must include certain mandatory information:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the rights assigned: reproduction, adaptation, distribution, representation, modification, translation, etc.<\/li>\n\n\n\n<li>the scope, purpose, location and duration of the rights assigned<\/li>\n\n\n\n<li>method of calculation and payment of the assigned right<\/li>\n<\/ul>\n\n\n\n<p>In France, the complete transfer of one&#8217;s copyright is not legal. According to the Code de la propri\u00e9t\u00e9 intellectuelle, the right of authorship is &#8220;perpetual, inalienable and imprescriptible&#8221;. (<a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006278891\/\" target=\"_blank\" rel=\"noreferrer noopener\"><u>Article L121-1 du Code de la propri\u00e9t\u00e9 intellectuelle<\/u><\/a>).<\/p>\n\n\n\n<p>The author must specify the exclusive or non-exclusive nature of the assignment.
